Congratulations to Jonathan Law and Dylan McDonald for successfully representing State Farm Mutual Automobile Insurance Company and securing another jury trial win in a recent underinsured motorist lawsuit pending in the 438th Judicial District Court of Bexar County, Texas. Prior to the trial, the plaintiff settled her claim with the underlying tortfeasor for the policy limits of $50,000.00 and sought the limits of the applicable State Farm underinsured policy at trial.
Plaintiff claimed approximately $32,000.00 in past medical specials and produced expert testimony from a neurosurgeon who opined that the plaintiff required surgical intervention for an estimated cost of $211,295.00. Plaintiff also sought damages for pain and suffering in the past and future, mental anguish in the past and future, lost wages in the past and loss of earning capacity in the future.
After a 4-day trial with the honorable Judge Rosie Alvarado presiding, on June 15, 2018, the jury returned a verdict of $43,345.00, which resulted in a take nothing judgment on behalf of State Farm Mutual Automobile Insurance Company.
